The defense attorney

En la mayoría de los países desarrollados, toda persona tiene derecho a un abogado, sin importar por qué ha sido arrestado. Si usted no puede pagar uno, la corte tiene que proveerle un abogado gratis.

In most developed countries, everyone has the right to an attorney, no matter what they have been arrested for. If you cannot afford one, the court has to provide you with one free of charge.

Luke trabaja duro todos los días. Ser un abogado defensor no es fácil. Como abogado, se debe estar preparado para trabajar muchas horas cada día. El trabajo es estresante y algunas veces muy frustrante. Para asegurarse que sus clientes obtengan un juicio justo, él debe investigar mucho, encontrar testigos, hablar con ellos y hacer montañas de papeleo.

Una de las primeras cosas que tiene que hacer es reunirse con su cliente y obtener su versión de la historia. Como abogado defensor, él tiene que defender sus clientes sin importar de qué se les acusa, incluso si está seguro de que han cometido crímenes. Luke works hard every day. Being a defense attorney is not easy. As a lawyer, you have to be prepared to work long hours everyday. The job is stressful and sometimes very frustrating. In order to make sure his clients get a fair trial, he has to do a lot of research, find witnesses, talk to them and do mountains of paperwork.

One of the first things he has to do is meet with his client and get his or her side of the story. As the defence attorney, he has to defend his clients no matter what they are accused of, even if he is sure that they have committed the crimes. This is sometimes easier said than done, as some of his clients are dangerous criminals.

Hoy él debe reunirse con el fiscal (abogado distrital, DA) acerca de uno de sus clientes. Su cliente es hombre, de 29 años y acusado de robo e incendio premeditado. Como no hubo testigos del crimen, él debe tratar de convencer al fiscal de que no tiene un caso firme, para que quiera hacer un arreglo. Si el fiscal no está de acuerdo, tendrán que ir a juicio y Luke tendrá que defender su cliente enfrente de un juez y un jurado.

Today he must meet with the District Attorney (the DA) about one of his clients. His client is male, aged 29 and is accused of robbery and arson. Since there were no witnesses to the crime, he must try to convince the DA that he doesn’t have a case so that he will want to make a deal. If he doesn’t agree, they will have to go to trial and Luke will have to defend his client in front of a judge and a jury.

Algunas veces Luke tiene problemas para dormir. ¿Qué pasa si uno de sus clientes es realmente culpable y tiene éxito en liberarlo? Sus amigos a menudo le hacen esa pregunta. “La mayoría de la gente asume que cuando a alguien se le acusa de un crimen, él o ella son culpables,” responde Luke. “Sin embargo, si es alguien cercano a ellos como un miembro de la familia o un amigo, no piensan lo mismo. Sometimes Luke has trouble sleeping. What if one of his clients is really guilty and he succeeds in getting him released? His friends often ask him that question. “Most people assume that when someone is accused of a crime, he or she is guilty,” replies Luke. “However, if it is someone of theirs like a family member or a friend, they don’t feel the same way. They will do anything to bring their loved ones home. That is how I like to treat my clients. What if he or she were a member of my family? Wouldn’t I do everything in my power to keep him or her out of jail?”

Un amigo de él le preguntó recientemente si él hacia el trabajo sólo por el dinero. “Por supuesto, me pagan muy bien como abogado defensor,” respondió Luke. “Alguna gente puede pensar que ésta es la razón principal por la que defiendo a mis clientes, pero no es cierto. Sostener a mi familia es muy importante para mí, pero también creo que todos se merecen otra oportunidad. El sistema judicial no es perfecto pero todos, sin importar quienes son o qué han hecho, tienen derecho bajo la ley a la mejor defensa posible”.

A friend of his asked him recently if he did the job just for the money. “Of course, I do get paid very well as a Defense Attorney,” replied Luke. “Some people may think that this is the main reason I defend my clients, but that’s not true. Providing for my family is very important to me, but I also believe everyone deserves another chance. The justice system is not perfect but everyone, no matter who they are or what they have done, is entitled under the law to the very best defense.”
